Chill To Win™ Contest ("Contest")
THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW. NO PURCHASE OR PAYMENT IS NECESSARY TO PLAY OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
The Contest consists of two games (each, a "Game"): (i) the in-restaurant Game (the "In-restaurant Game"); and (ii) the online Game (the "Online Game"). Play for the In-restaurant Game starts on June 9, 2014 at 12:00:01 a.m. Eastern Time ("ET") and ends once all Game Cups (defined below) have been distributed or August 27, 2014 at 11:59:59 p.m. ET, whichever occurs first (the "In-restaurant Game Period"). Play for the Online Game starts on June 9, 2014 at 10:00:00 a.m. ET and ends on September 22, 2014 at 10:00:00 a.m. ET (the "Online Game Period").
The Games are limited to legal residents of Canada who: (i) have reached the legal age of majority in their province/territory of residence; or (ii) are thirteen (13) years of age or older, but under the age of majority in their province/territory of residence (each, a "Minor"), and who have permission from their parent/legal guardian to participate in this Contest and be bound by these Official Rules and Regulations (the "Rules"). Employees of, members of the immediate family of, or those domiciled with an employee of, Tim Hortons Advertising and Promotion Fund (Canada) Inc. (the "Sponsor"), Millennium Process Coupon, Inc. (the "Administrator"), The TDL Group Corp., Tim Hortons Inc., their affiliated or related companies, Tim Hortons franchisees/licensees, the consulting, advertising and promotion agencies of Sponsor, prize suppliers, Game Cup (defined below) suppliers, Game Cup distributors and Game Cup carriers (collectively, the "Contest Parties") are not eligible to participate. Employees of Tim Horton's franchisees/licensees as described in this paragraph are limited to those employees who are providing services in any way to a Tim Hortons Restaurant. "Immediate family" means parents, siblings, children or spouse.
How to Play the In-Restaurant Game:
Commencing on or around June 9, 2014 guests at participating Tim Hortons locations in Canada may receive one (1) specially marked Tim Hortons 16 or 20 oz. cold drink take-out game cup ("Game Cup"), while supplies last, with the purchase of any corresponding medium (16 oz.) or large (20 oz.) cold beverage. On each Game Cup is a peel off tab ("Tab"). Remove the Tab to reveal: (i) if you are a potential In-Restaurant Prize (defined below) winner; and (ii) the alphanumeric code associated with your Game Cup ("PIN Code"). This PIN Code can be played in the Online Game (see below for details) at www.chilltowin.com or m.chilltowin.com on your mobile device.
A total of 39,996,000 Game Cups have been produced for this Contest. Game Cups will be available for distribution through to the end of the In-restaurant Game Period. It is anticipated, based on estimated distribution, that Game Cups will be distributed within five (5) regions (each, a "Region"), as follows:

NOTE: Sponsor reserves the right to limit the distribution of Game Cups to one (1) Game Cup with the purchase of any medium (16 oz.) or large (20 oz.) cold beverage that is requested to be placed in any multiple-cup refillable container. The guest will receive a Game Cup equivalent in size to the size (i.e. medium [16 oz.] or large [20 oz.]) of the cold beverage purchased (for example, if the guest purchases a large cold beverage, the guest will receive a large Game Cup, while supplies last). If there is any remaining inventory, Game Cups may still be provided after the close of the In-restaurant Game Period. Nevertheless, PIN Codes may not be played after the close of the Online Game Period.
How to Play the Online Game:
Go to www.chilltowin.com or m.chilltowin.com on your mobile device (the "Website") and follow the on-screen instructions to fully complete the official registration form (the "Form"), which will require you to: (i) enter your full name, complete address, telephone number (including area code), and e-mail address (supplying your date of birth and salutation are optional); and (ii) signify that: (a) you have reached the age of majority in your province/territory of residence and your agreement that you have read and agree to be legally bound by the terms and conditions of these Rules; or (b) you are a Minor and both you and your legal guardian have read and agree to be legally bound by these Rules. Once you have fully completed and submitted the Form during the Online Game Period with all required information and have agreed to the Rules, you will have registered for the Online Game. Once you have registered for the Online Game, from the Website, follow the on-screen instructions to: (i) click "Play Now" to submit a daily play (a "Daily Play"); and (ii) once you have submitted your Daily Play, you may enter your PIN Code and click "Play Again" to submit your PIN Code (a "PIN Code Play") (collectively, PIN Code Plays and Daily Plays may be referred to as "Online Plays" and each, an "Online Play"). The time of day when you submit your Online Play during the Online Game Period and the order in which Online Plays are received during the Online Game Period will determine if you are a potential Online Prize (defined below) winner (see below for details). To be eligible, your Online Play must be submitted and received in accordance with these Rules during the Online Game Period. Each PIN Code/PIN Code Play/Daily Play may only be submitted once. There is a limit of one (1) Daily Play per person per Day (whereby a "Day" is defined as beginning at 12:00:00 a.m. ET and ending at 11:59:59 p.m. ET), regardless of the number of PIN Codes previously submitted during the Online Game Period. There is a limit of ten (10) PIN Code Plays per person per Day. Accordingly, there is a total limit of eleven (11) Online Plays per person per Day. Online Plays may not be played after the close of the Online Game Period.
All Online Plays are subject to verification at any time and for any reason. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed these limits; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest (and all of his/her Online Plays voided) in the sole and absolute discretion of the Sponsor.

No Purchase Game Cup:
Receive a free Game Cup (while supplies last) by sending a postage-paid envelope to: Chill To Win 2014 Contest (NPN - Project # 246C4), PO BOX 13247 Saint John, N.B. E2L 5E7, Canada. Each Game Cup request must include a single 3x5 piece of paper on which you have legibly hand-printed (or mechanically printed) your full name, complete mailing address (including postal code), telephone number (including area code) and e-mail address. All requests for a free Game Cup must be postmarked during the In-Restaurant Game Period and received by no later than September 3, 2014. Each In-restaurant Prize claimed pursuant to In-restaurant Prize Claim Package (defined below) that contains a winning Tab obtained from a Game Cup obtained, in turn, pursuant to a request for a free Game Cup (as determined by the Administrator at its sole discretion) that was postmarked between August 4, 2014 and the end of the In-Restaurant Game Period, such In-restaurant Prize shall be deemed to have been claimed by August 31, 2014 (despite the fact that such In-restaurant Prize Claim Package may not have been postmarked by August 31, 2014), provided such In-restaurant Prize Claim Package is received by no later than September 30, 2014 at 11:59:59 p.m. ET; otherwise such In-restaurant Prize claim shall be null and void and ineligible for an In-restaurant Prize. No mechanical reproductions of a free Game Cup request will be permitted. PIN Codes must be played before the end of the Online Game Period. There is no limit to the number of free Game Cup requests that may be made by an eligible individual; however each free Game Cup request must be mailed in a separate envelope bearing sufficient postage. For greater certainty, there is a limit of one (1) free Game Cup request per postmarked outer envelope. Any individual who sends a Game Cup request that does not comply with the foregoing requirements (as determined by the Administrator at its sole discretion) will not be eligible to receive a free Game Cup in response to such Game Cup request.
- Ten (10) $5,000 CAD cash prizes, awarded in the form of a cheque made out to the applicable winner ("Cash Prizes"). Limit of one (1) Cash Prize per person.
- One Hundred (100) 47" LG IPS Televisions, each with an approximate retail value of $1,000 CAD ("TV Prizes").
- Ten thousand (10,000) $25 Tim Cards, each subject to the terms and conditions of the issuer ("Tim Card Prizes").
The distribution of Tim Card Prize winning Game Cups across the Regions is random. The estimated distribution of Cash Prize and TV Prize winning Game Cups by Region is as follows (the distribution of Cash Prize and TV Prize winning Game Cups within each Region is random):

The regional allocation of Cash Prizes and TV Prizes as set out above is an estimate only, based on anticipated Game Cup distribution per Region. Actual allocation of Cash Prize and TV Prize winning Game Cups per Region may vary depending on Game Cup consumption and free Game Cup requests. The Releasees (defined below) are not responsible for Game Cups or Tabs which are lost, stolen, mutilated, destroyed or not distributed.
- Twenty-eight (28) $1,000 Visa Prepaid cards, each subject to the terms and conditions of the issuer ("Visa Prizes").
Prizes are only as detailed above and all other characteristics and features of a prize (except as otherwise detailed above) are at the Sponsor's sole discretion. Prizes must be accepted as awarded and are not convertible to cash. No substitutions or transfers of prizes by winner permitted. Sponsor reserves the right to substitute prizes of equal or greater value, at its sole discretion, including, without limitation, but at Sponsor's sole and absolute discretion, a cash award. The number of prizes available to be won will decrease as prizes are claimed.
All In-Restaurant Prizes must be claimed by August 31, 2014 at 11:59:59 p.m. ET (see below for details). All Online Prizes must be claimed by September 30, 2014 (see below for details).
The retail values set above are based on approximate prize values at the time of printing these Rules. All taxes on prizes are the sole responsibility of winner. In order to receive a prize, the applicable winner will be required to correctly answer a mathematical skill-testing question without mechanical or other aid and may be required to complete prize claim documentation, including a Declaration and Release, before being declared a winner (see below for further details). Please allow 4-6 weeks after prize claim verification for the prizes to be shipped. Cash Prizes will be awarded at the Tim Hortons restaurant where the applicable Game Cup was originally received (if applicable) or at a Tim Hortons restaurant close to the applicable Prize winner's residence (as determined by the Sponsor at its sole discretion), whereas TV Prizes, Tim Card Prizes and Visa Prizes will be sent to the winner's home address (as provided). Prizes may not be exactly as shown in promotional materials.
Winner Selection Process:
In-restaurant Prizes: On your Game Cup, peel off the Tab to reveal if you are a potential In-Restaurant Prize winner. In order to be eligible, potentially winning Tabs must include the entire printed potential winner notification message ("Message"). Sponsor reserves the right in its sole discretion to reject any Tab that is not presented in its entirety.
All potentially winning Tabs for Cash Prizes and TV Prizes will have to be individually inspected, produced and confirmed to be completely legible.
The Message printed under a Tab for the various In-restaurant Game Prizes are substantially as follows: (i) Win Tim Card; (ii) Win $5,000; and (iii) Win LG TV.
To be eligible to claim a prize, a prize claimant must have reached the age of majority in his/her province/territory of residence. In the event a Minor receives a winning Tab, he/she is permitted to transfer such Tab to his/her parent or legal guardian, who will then be deemed the eligible entrant.
HOW TO CLAIM A TV PRIZE OR CASH PRIZE: If you are eligible to win a TV Prize or Cash, complete Prize Claim Form I (see the reverse of these Rules). Upon receipt, the Administrator will then contact you by telephone, at a mutually convenient time, to administer a time-limited, mathematical, skill-testing question.
HOW TO CLAIM A TIM CARD PRIZE: If you are eligible to win a Tim Card Prize, complete Prize Claim Form I and Prize Claim Form II (see the reverse of these Rules). Prize Claim Form II includes a mathematical, skill-testing question.
FOR ALL IN-RESTAURANT PRIZES: Attach your complete original winning Tab to your completed applicable Prize Claim Form(s) (see above for details), then send your complete original winning Tab attached to your completed applicable Prize Claim Form(s) by REGISTERED MAIL, return receipt requested to: PO BOX 13246 Saint John, N.B. E2L 5E7 (collectively, a "In-restaurant Prize Claim Package"). Before sending your complete original winning Tab as provided above, please ensure to submit the associated PIN Code in the Online Game (as provided above) as Tabs will not be returned. Keep a copy of your winning Tab and completed applicable Prize Claim Form(s) for your records, as we will not be responsible for lost or delayed prize claims.
In-restaurant Prize Claim Packages must be postmarked by August 31, 2014 and received at the above P.O. Box number by no later than September 30, 2014 at 11:59:59 p.m. ET; otherwise such In-restaurant Prize claim shall be null and void and ineligible for an In-restaurant Prize. Despite the foregoing, as provided above, each In-restaurant Prize claimed pursuant to an In-restaurant Prize Claim Package (defined below) that contains a winning Tab obtained from a Game Cup obtained, in turn, pursuant to a request for a free Game Cup (as determined by the Administrator at its sole discretion) that was postmarked between August 4, 2014 and the end of the In-Restaurant Game Period, such In-restaurant Prize shall be deemed to have been claimed by August 31, 2014 (despite the fact that such In-restaurant Prize Claim Package may not have been postmarked by August 31, 2014), provided such In-restaurant Prize Claim Package is received by no later than September 30, 2014 at 11:59:59 p.m. ET; otherwise such In-restaurant Prize claim shall be null and void and ineligible for an In-restaurant Prize. Submission of an In-restaurant Prize Claim Package is the sole responsibility of the individual seeking verification. The Releasees (defined below) are not allowed to submit an In-restaurant Prize Claim Package on behalf of potential winners.
Online Prizes: Online Prizes will be awarded online based on randomly selected times during the Online Game Period. The first eligible participant to submit an Online Play on or after the random pre-selected time for that Online Prize will be eligible to win. If there are multiple Online Prizes that are unawarded before an eligible participant submits an Online Play, then the unawarded Online Prizes will be awarded in order, one (1) Online Prize per participant to the eligible participants who submitted Online Plays closest after the randomly selected time in the order that they submitted Online Plays. If there is no participant who submits an Online Play on or after the randomly selected time on the last day of the Online Game Period, then the applicable Online Prize(s) will be awarded in reverse descending order, one (1) Online Prize per participant to the participant who submitted an Online Play closest to the randomly selected time for that particular Online Prize. Potential winners will be notified online via email (using the information provided at the time of registration) and instructed as to how the Online Prize can be claimed. All Online Prizes must be claimed by September 30, 2014 (see below for details). Unclaimed prizes will not be awarded. Potential winners must first answer correctly, unaided, a time-limited, arithmetical, skill-testing question to be administered online, before being declared a winner. Potential winners may also be required to complete and return prize claim documents for verification before being declared a winner. If a potential winner is a Minor, his/her parent or legal guardian must sign and return all such documents and the applicable Online Prize will have to be claimed by the parent or legal guardian who signed such prize claim documents.
Odds of Winning:
In-restaurant Prizes: At the outset of the In-restaurant Period, the overall approximate odds of winning:
- A Cash Prize are 1 in 3,999,600;
- A TV Prize are 1 in 399,960; and
- A Tim Card Prize are 1 in 4,000.
NOTE: The odds of obtaining a winning Game Cup will vary by Region based on Game Cup distribution as outlined above and will change throughout the In-restaurant Game Period as Game Cups are distributed in each Region. The total number of In-restaurant Prizes available to be won will decrease throughout the In-restaurant Game Period as Tabs are distributed and In-restaurant Prizes are claimed.
Online Prizes: Online Prizes are randomly time-seeded throughout the Online Game Period as set forth above and awarded to the participant who submits an Online Play on or after the pre-selected time. Odds of being deemed a potential Online Prize winner will depend on the time of day when you submit your Online Play during the Online Game Period (as recorded by the Website technology), and the order in which Online Plays are received during the Online Game Period. The total number Online Prizes available to be won will decrease throughout the Online Game Period as Online Plays are submitted and Online Prizes are claimed.
By participating in this Contest, participants agree to be bound by these Rules and all decisions of the Sponsor and Administrator, which are final. Without limitation, Sponsor reserves the right to administer a skill-testing question as it deems appropriate to address discrimination or disability issues.
Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof in a form satisfactory to Sponsor may result in disqualification. All personal and other information requested by and supplied to Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. Sponsor reserves the right, in its sole discretion; to disqualify any participant should such a participant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information. If documents are not returned by the date required, or if a potential winner is found to be ineligible or not in compliance with these Rules, such potential winner's prize will be forfeited and Sponsor reserves the right to not award such prize.
If due to a production or printing error or other unforeseen error, there are more claims for prizes than prizes stated in these Rules; Sponsor reserves the right to award prizes through a random drawing of eligible prize claims for the applicable prize level. No more than the stated number of prizes shall be awarded. Should a potential winner decline a prize or be unreachable, such prize will be forfeited and Sponsor reserves the right to not award such prize. Liability for any misprinted Tab or PIN Code (including, without limitation, any Tab or PIN Code that is irregular, illegible or blank) is limited to replacement with another Tab or PIN Code (as applicable) while supplies last during the Online Game Period.
Any Game Cup, Tab or PIN Code obtained through unauthorized or illegitimate sources/channels, including any Game Cup, Tab or PIN Code purchased or obtained online, or at a live auction; or which are not original, are illegible, have been tampered with, mutilated, altered, reproduced, stolen, forged, counterfeited, irregular, marked improperly; or which contain printing or production errors, or any errors in any way, will be void at the sole discretion of the Sponsor.
All In-restaurant Prize Claim Packages and any other information or materials submitted become the property of Sponsor, which assumes no responsibility for lost requests, or for any failure of any website (including, without limitation, the Website) during the Online Game Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or Online Play to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website (including, without limitation, the Website), or any combination thereof. Sponsor is not responsible where a participant is unable to access the Online Game on their mobile device, computer or other device.
In the event of a dispute between participants as to who submitted an Online Play in the course of the Online Game, the Online Play shall be deemed to have been submitted by the authorized e-mail account holder of the e-mail address submitted at the time of registering for the Online Game. "Authorized e-mail account holder" is defined as the natural person to whom an e-mail address is assigned by an Internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential Online Prize winner may be requested to provide Sponsor with proof that such potential winner is the authorized e-mail account holder of the e-mail address associated with the potentially winning Online Play.
Any attempt to deliberately damage any website (including, without limitation, the Website) or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Should it be discovered that a participant is using the aid of computer software programs to auto-fill a Form or submit an Online Play; the participant will be immediately disqualified from the Contest. The Sponsor reserves the right to disqualify all participants who tamper or auto-fill or otherwise attempt to compromise the integrity of the Contest from this Contest (and all of his/her PIN Codes/Online Plays/prizes) and future contests conducted by the Sponsor without further notice.
Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his/her PIN Codes/Online Plays/prize claims) who tampers with the letter or spirit of the Contest as contemplated by these Rules. Sponsor reserves the right, in its sole discretion subject to the approval of the Régie des alcools des courses et des jeux ("RACJ"), to modify, suspend or cancel the game should fraud, a virus, "bug" or other cause beyond the reasonable control of Sponsor corrupt the security or proper administration of the Contest or if Sponsor determines that for any reason the Contest cannot be run as originally planned or if there is any other occurrence compromising the fairness or integrity of the Contest.
By accepting a prize, the applicable winner releases the Contest Parties and their respective officers, directors, employees and agents ("Releasees"), from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of any prize.
Winner acknowledges that Releasees have not made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers' terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. By participating in the Contest, participants agree to abide by these Rules and the decisions of Sponsor and/or the Administrator, which are final.
By participating in the Contest and/or accepting a prize (if applicable), participants agree that Sponsor may use their name, town/city, province/territory/state of residence, voice, photograph and/or likeness in any publicity or advertisement carried out by Sponsor, without further remuneration or notice.
By participating in the Contest, participants consent to being contacted by Sponsor for Contest-related purposes, which includes but is not limited to prize eligibility notifications and prize claim reminder notifications. You may unsubscribe from these notices by emailing ChillToWin@timhortons.com, in which case you will be disqualified from the Contest and you will no longer be eligible to participate or win unless you re-register.
In Québec, any litigation respecting the conduct or organization of this publicity game may be submitted to the Régie des alcools des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
In the event of any discrepancy or inconsistency between the English language version and the French language version of these Rules or any English or French Contest-related materials, the English version of these Rules shall prevail, govern and control.
Information regarding all winners (i.e. their first name and the initial(s) of their last name(s)) will be available, following confirmation of all winners, at www.chilltowin.com.
